Terms of service

These terms govern your use of berwick.ai (the "Platform"), a service operated by Berwick IT, represented by Flavien Berwick ("we", "us"). By creating an account or using the Platform you accept these terms. If you use the Platform on behalf of a company, you confirm you are authorized to bind it.

1. The service

The Platform offers two delivery modes:

Curated AI MVP ("AI-curated works"): AI agents build a software MVP under the direction and supervision of Flavien Berwick. You follow the build live, read the code as pull requests, and approve the delivery.
Direct quote: a bespoke engagement hand-built by Flavien Berwick himself, scoped and priced through a custom quote.

The Platform is in alpha. It is an experimental product, provided without any availability commitment or service-level agreement. Features may change, be interrupted, or be withdrawn at any time.

2. Experimental product - AI-curated works and liability

AI-curated works are experimental and delivered "as is". Any work produced by AI agents through the Platform does not engage Berwick IT in any liability, to the maximum extent permitted by applicable law. This is an experimental product: you are solely responsible for reviewing, testing, and validating every AI-curated deliverable before any use, and for any consequence of using it.

Berwick IT gives no warranty, express or implied, that AI-curated works are free of defects, secure, fit for a particular purpose, or compliant with regulations applicable to your activity. Human review by Flavien Berwick is a quality practice, not a guarantee of the output. Where applicable law does not allow a full exclusion of liability (in particular in case of gross negligence, willful misconduct, or mandatory consumer rights), Berwick IT's total liability is capped at the amounts you paid for the project concerned in the 12 months preceding the claim.

3. MVP only - do not use against production infrastructure

AI-curated works are for MVP and demonstration purposes only. We strongly advise against running, connecting, or deploying an AI-curated work on or against production infrastructure, production data, or any system whose failure could cause harm. This is for MVP!

For production deployments, use the Direct quote path: a production-grade engagement reviewed, hardened, and delivered by Flavien Berwick under a separate, explicitly agreed scope.

If you nonetheless choose to use an AI-curated work in production or against production systems, you do so entirely at your own risk and against our express advice, and you release Berwick IT from any resulting claim to the maximum extent permitted by law.

4. Accounts

You must provide accurate information and keep your credentials confidential; you are responsible for activity under your account.
A verified email address is required before creating a project, because project lifecycle notifications are sent by email.
We may suspend or close accounts that breach these terms or threaten the security of the Platform.

5. Credits, quotes, and payment

Curated AI MVPs are paid with prepaid credits (1 credit = 1 EUR), topped up through Stripe. Builds consume credits based on actual AI usage, metered live on your dashboard.
Estimates shown before a build are good-faith estimates, not fixed prices; actual consumption may differ.
Direct-quote work is priced by a custom quote you explicitly accept before work starts. Submitting a request is free.
Credits are not transferable between organizations. For questions about refunds of unused credits, contact us at [email protected]; statutory rights, where applicable, are unaffected.

6. Your content and obligations

You warrant that the content you submit (project descriptions, attachments, code, credentials) is lawful and that you hold the rights needed to share it.
You must not request work that is illegal, infringes third-party rights, or falls under our review triggers for prohibited or sensitive actions (for example malicious tooling or acting on infrastructure you do not control); such requests are refused or routed to human review.
Credentials you store in project Memory are shared at your own initiative so the build agent can use them; scope them to the minimum access needed and rotate them after the engagement.
You must not attempt to probe, disrupt, or access data on the Platform that is not yours.

7. Intellectual property

Upon full payment, the code delivered to your repository for your project is yours.
Berwick IT retains all rights to the Platform itself, its knowledge base, prompts, tooling, and pre-existing know-how, which are licensed to no one through a delivery.
Deliverables may include open-source components, which remain governed by their own licenses.

8. Demos

Live demos run on temporary, password-protected subdomains for evaluation only. They are not hosting: demos can be stopped, restarted, or removed at any time and carry no uptime or data persistence commitment.

9. Termination

You can close your account at any time. We can terminate or suspend access for breach of these terms, with notice where reasonably possible. Sections 2, 3, and 7 survive termination. Personal data is handled as described in the privacy policy.

10. Changes to these terms

We may update these terms as the service evolves. Material changes are announced on the Platform or by email before they take effect; continued use after that constitutes acceptance.

11. Governing law and jurisdiction

These terms are governed by Estonian law. Any dispute that cannot be resolved amicably is submitted to the competent Estonian courts, Harju County Court in Tallinn being the court of first instance, without prejudice to mandatory jurisdiction rules protecting consumers.
